USA v. Luke Wenke: Probation Violation #1

This page contains four sets of documents pertaining to Luke Wenke’s first violation of supervised release (VOSR) charge. In May of 2023 — just six weeks after he was released from federal prison — Luke Wenke was accused of violating the terms and conditions of his probation by indirectly contacting his cyberstalking victim’s business partner. The judge ultimately ruled that the correspondence constituted indirect contact with the victim and found Wenke guilty of the charge. Wenke was sentenced to time served along with additional conditions of supervision.

The first set of documents consists of a copy of the arrest warrant, the U.S. Government’s (prosecution’s) post-hearing brief, and the defense’s post-hearing brief.

The second set of documents contains the U.S. Government’s (prosecution’s) sentencing memorandum along with five exhibits, including screenshots of Luke Wenke’s incriminating social media posts, a copy of the email Wenke was accused of sending to Victim 1’s business partner, and a handwritten letter Wenke was accused of sending to another victim while detained at the Chautauqua County Jail. According to court records, Wenke sent the handwritten letter in violation of a state-issued order of protection, which he was required to abide by as a condition of his supervision.

The third set of documents consists of two transcripts from violation hearings that took place on June 21, 2023 and June 23, 2023.

The fourth set of records contains the official judgment against Luke Wenke, who was found guilty of violating probation and sentenced to time served.
