USA v. Luke Wenke – Motion & Order For a Competency Evaluation

The PDF reader below contains three USA v. Luke Wenke documents from July-September of 2024. The first among them is a motion filed by Luke Wenke’s public defender requesting a competency evaluation, followed by the judge’s order granting the motion and an amended order in response to the same motion.

At the time, Wenke was detained on federal remand at the Orleans County Jail in Albion, New York, where he was awaiting sentencing for a probation violation conviction that he had pleaded guilty to in November of 2023. Wenke’s sentencing was delayed by lingering concerns surrounding his mental state, resulting in various evaluations to determine the correct course of the case.

Following the evaluation detailed below, the judge overseeing the case deemed Luke Wenke competent while voicing his continued suspicion that the defendant was suffering from mental illness. This ultimately led to additional evaluations and a hearing in 2025 which led to Wenke being involuntarily committed to mental health treatment.
